Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the http://www.scanactive.com website and the Check4ID App for Android, iOS, Windows and MacOS (the "Service") used. managed by ScanID B.V. ("us", "we" or "our").
Your access to and use of the service and portal is subject to your acceptance and compliance with these Terms. These terms apply to all visitors, users and others who access or use the service.
All intellectual and copyright rights related to the Service and the format and content of the versions for Android, iOS, Windows and MacOS (the data, images, logos, sounds, texts and other information contained therein) and the portal ScanActive.com, which rests exclusively with ScanID BV and / or its licensors or related authors (hereinafter jointly referred to as: "ScanID").
Without the prior written permission of ScanID, it is not permitted, among other things, to forward, distribute or make available to third parties the content of the Service or affiliated portal scanactive.com, or any part thereof, except to the extent strictly is necessary to use the Service and Scanactive.com.
ScanID has the right, but not the obligation, to withhold access to information or to remove information from the Service versions or Scanactive.com if, in the sole opinion of ScanID, there are (possible) infringement of third party rights.
ScanID expressly reserves these rights.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with some of the terms, you may not be able to access the Service. The content of the Service, as well as its affiliate website (s) and scanactive.com portal, may be used only for your personal use.
The Service and Scanactive.com have a usage limit based on “fair use”.
Fair use is when you use a maximum of one and a half times as much data traffic and storage as other customers of ours would under similar circumstances.
If you consume more than is permitted on the basis of fair use, we have the right to charge an additional amount afterwards in accordance with the usual rates. If an excessive amount of data traffic is consumed by an external cause, such as a (d) dos attack, we have the right to reasonably charge you for the costs.
We are not liable if the Service and / or Scanactive.com do not function properly if the usage limits are exceeded.
We will provide a reasonable level of direct support to you regarding
- (1) technical and practical questions about the use of the Equipment, the Service and Scanactive.com, and
- (2) technical problems and malfunctions.
The support as described above is offered through our helpdesk. You can contact the helpdesk (during office hours) by email or by phone. The current contact details of the helpdesk are stated by us on the Website.
We strive to handle helpdesk requests as soon as possible. However, the time it takes to resolve reports can vary, as reports can address a variety of requests or issues.
An Account is required to use the Service and / or Scanactive.com. You can create an Account via Scanactive.com. In addition, we can create an Account for you. Use of the Account is the responsibility and risk of you as a customer.
We may assume that everything that happens from the Account is under the direction and supervision of you as a customer.
If the login details of the Account are lost or leaked, you must immediately change the password and take any other measures that are reasonably necessary and desirable to prevent misuse of the Account.
You must notify us promptly, at the latest within one hour of discovery, if you suspect that the Account is being misused so that we can take appropriate action.
We will make the Service and Scanactive.com available over the Internet and we strive to keep it available as much as possible. However, we cannot provide any guarantees in this regard, unless otherwise provided in a Service Level Agreement.
If, in our opinion, there is a danger to the functioning of our or third party's computer systems or network, for example in the event of a (d) dos attack or activities of malware or other malicious software, we have the right to take all measures we deem necessary to avert danger and limit or prevent damage. This may result in the Service of Scanactive.com being temporarily or only partially available.
Updates and upgrades:
We may release updates and / or upgrades to the Service and Scanactive.com to fix errors, add new features or improve performance.
If, in our opinion, material changes are made to the functionality of the Service and / or Scanactive.com in the updates and / or upgrades, we will notify you by e-mail as much as possible in advance.
Making updates and / or upgrades can lead to the Service and Scanactive being temporarily or only temporarily unavailable. Where possible we will announce this in advance by email. However, emergency maintenance can be performed at any time and without prior notice.
We may link Equipment, the Service and / or Scanactive.com with third party software or services. You agree in advance with any conditions of the third parties concerned, which we (if applicable) will provide to you in time.
We cannot accept any liability for links with third party software and services. Result and effort obligations that rest on us do not apply to links made or to the software and services of third parties with which a link is made.
If Equipment, the Service and / or Scanactive.com is linked to third-party software or services, any changes and / or malfunctions with regard to this third-party software or services may also affect the operation of the Equipment, the Service and / or affect Scanactive.com.
We are not liable for any resulting damage, but make every effort to resolve any issues as soon as possible, to the extent that it is within our power.
If you wish to purchase a product or service made available through the Service ("Purchase"), you may be asked to provide certain information relevant to your Purchase, including, but not limited to, your business and personal data, email address, Chamber of Commerce number and VAT number.
The products, being hardware and software, will be invoiced in advance.
Some parts of the Service are billed on a subscription basis ("Subscription (s)"). You will be billed in advance for the fixed term of the subscription.
